TERMS OF USE

In these terms, the following definitions apply:

Reflection period: the period for consumers to exercise the right of withdrawal;
Consumer: a natural person acting outside trade, business, craft or profession;
Day: a calendar day;
Digital content: data generated and provided digitally;
Permanent contract: a contract for regular delivery of goods, services or digital content over a specified period;
Durable data carrier: any tool (including email) enabling storage of information for future reference with unchanged retention and copying;
Right of withdrawal: consumers’ right to terminate distance contracts during the reflection period;
Entrepreneur: a natural/legal person providing products, digital content or services remotely;
Distance contract: a contract concluded wholly/partly via remote communication technologies without physical meeting;
Sample withdrawal form: available in Annex I (not required if withdrawal right does not apply);
Remote communication technology: technologies enabling agreement without simultaneous physical presence.

These terms apply to all offers and distance contracts between the entrepreneur and consumers. Before conclusion, terms must be made available to consumers; if not, access methods must be explained, with free delivery upon request. For electronic contracts, terms may be provided electronically for review/storage; if unavailable, an electronic access location is indicated. Conflicts with specific terms allow consumers to invoke the most favorable provisions.

Offers must fully describe products/services, with truthful images. Obvious errors are non-binding. Each offer includes acceptance-related rights/obligations.

Agreements are concluded when consumers accept offers. Electronic acceptance requires immediate confirmation; consumers may withdraw until confirmation. Electronic agreements require security measures for data and payments. Entrepreneurs may verify consumers’ payment capabilities, with right to refuse/condition orders for legitimate reasons.

Upon delivery, entrepreneurs must provide: complaint address, withdrawal details, guarantee info, prices (including taxes/delivery), termination terms for long-term contracts, and withdrawal form if applicable.

Consumers may withdraw from product contracts within 14 days via email, no justification needed. The period starts after receipt (last item for multiple products/batches).

Preferential prices are stable except for tax changes, including VAT.

Orders are fulfilled within 30 days (or agreed date). Delays/incomplete delivery allow free contract termination and compensation. Risk remains with entrepreneurs until delivery.

Complaints must be submitted clearly within a reasonable period. Entrepreneurs respond within 14 days; complex cases require acknowledgment and timeline. A 4-week resolution period precedes dispute procedures.

Additional conditions must not harm consumers and be accessible via durable data carriers.
